Terms & Conditions for Kana

These Terms & Conditions ("Terms") govern your use of the Kana mobile application (the "App") operated by Der Huber - Christian Huber ("we", "our", or "us").

By downloading, installing, or using Kana, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Use of the App

Kana is a task management application designed to help you organize your daily tasks. You may use the App for personal, non-commercial purposes in accordance with these Terms.

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse-engineer, decompile, or disassemble the App
• Interfere with or disrupt the App's functionality
• Reproduce, distribute, or create derivative works from the App

2. Paid Plans and Payments

Kana may offer premium features through in-app purchases. Paid plans may include monthly and yearly auto-renewing subscriptions, as well as a separate one-time lifetime purchase. Purchases and entitlements may be managed through RevenueCat and are billed through Google Play.

• Payment will be charged to your Google Play account at confirmation of purchase.
• Monthly and yearly plans are subscriptions that renew automatically unless auto-renewal is turned off at least 24 hours before the end of the current billing period.
• Your account will be charged for subscription renewal within 24 hours prior to the end of the current billing period at the rate shown in the store listing at the time of renewal.
• You can manage and cancel auto-renewing subscriptions in your device's Google Play subscription settings.
• The lifetime option is a one-time purchase, not a subscription. It does not auto-renew and there is no recurring billing cycle to cancel.
• A lifetime purchase grants the lifetime entitlement offered for Kana on the platform and store account used for the purchase, for as long as we continue to make that entitlement available on that platform.
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription plan.

Refunds are subject to Google Play policies and are not handled directly by us.

3. Intellectual Property

All content, design, graphics, and code within the App are owned by us and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal purposes only.

4. User Content

Any tasks, notes, or other content you create within the App remain yours. We do not claim ownership over your content. Your data is stored locally on your device unless otherwise specified.

5. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

6. Limitation of Liability

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill arising out of your use of the App.

7. Termination

We reserve the right to suspend or terminate your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.

You may stop using the App at any time by uninstalling it from your device.

8. Changes to These Terms

We may update these Terms from time to time. Changes will be posted within the App or on our website with an updated effective date. Continued use of the App after changes constitutes acceptance of the updated Terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Austria, without regard to its conflict of law provisions.
